Hershey Terms and Conditions

The Hershey Company (including its various subsidiaries and affiliates) (“Hershey,” “we,” or “us”) operates several websites. Your use of these websites (collectively, the “Websites”) is subject to the following terms and conditions (these “Terms”). By accessing and using the Websites, including through the Internet, through a mobile network, or otherwise, you indicate your acknowledgement and acceptance of these Terms. If you do not agree with the Terms, you should not use the Websites.

Use of Materials on the Websites

Hershey maintains websites for your personal entertainment, information, and education. The trademarks, service marks, brand identities, titles, characters, trade names, graphics, designs, copyrights, and other properties appearing within the Websites are protected intellectual properties used by The Hershey Company and/or its related companies. These properties may not be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, except that you may, for personal and non-commercial use only, download one copy onto your personal computer. In order to protect these valuable assets, we must prohibit other uses without our prior written consent. Except as expressly provided above, nothing contained herein shall be construed as conferring any license or right under any copyright or other intellectual property right.

Idea Submission Policy and Your Communications to Hershey

Hershey likes to hear from consumers and what they think about our products. However, in your communications with Hershey, please keep in mind that Hershey only accepts or considers creative ideas or suggestions relating to products or marketing plans via online submission. Therefore, please do not send to Hershey or any of our employees any creative or original materials, such as ideas for products or any other creative suggestions, ideas, concepts, or other information. Our creative departments are continuously researching and launching new product, packaging, and marketing ideas. Often, these ideas are in the developmental stage for years prior to actually being launched. If you choose to forward or transmit to the Websites by email or otherwise any suggestions or similar communications or materials (collectively, “Feedback”), such Feedback, including any personal information, questions or answers, comments, suggestions, or the like, will be treated as non-confidential and non-proprietary. Furthermore, Hershey is free to use any ideas or concepts contained in any communication you send through and in connection with the Websites for any purpose whatsoever, including but not limited to developing, manufacturing, and marketing products using such information.

Technical Disclaimer

The materials provided on the Websites could include technical inaccuracies or other errors. Your use and browsing of the Websites is at your own risk. Neither Hershey nor any other party involved in creating, producing, or delivering the Websites shall be liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to, or use of, the Websites. We do not warrant that the functional aspects of the Websites will be uninterrupted or error free or that the Websites or the server that makes it available are free of viruses or other harmful components.


Please note that some jurisdictions may not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. Hershey reserves the right to make changes to the Websites at any time without notice.

Online Purchases

If you elect to purchase tickets to Hershey's Chocolate World attractions through the Websites, you must provide valid credit card and billing information. Such information will be collected by a vendor handling ticketing sales transactions on our behalf. Your information will be collected and used in accordance with our Privacy Policy. When you purchase tickets to Hershey's Chocolate World attractions, the ticketing options and corresponding prices will be made clear during the order process. You agree to pay the price that is stated at the time of your order, as well as any applicable taxes. You also agree to have your credit card billed for the total amount displayed at checkout. All ticket purchases are final and no refunds will be given. By purchasing tickets to Hershey's Chocolate World attractions, you represent and warrant to Hershey that you are capable of entering a contract under the laws of the United States. The most recent terms of use will be posted on the Websites. By agreeing to these Terms, you also agree to future changes.


Hershey has not reviewed all of the websites linked to the Websites and is not responsible for the contents of any off-site pages or any other websites linked to the Websites. The inclusion of any link to such websites does not imply endorsement by Hershey of the websites. You acknowledge and agree that your linking to other websites and your use of such websites is at your own risk. You may link your personal, non-commercial website to us. However, we reserve the right to refuse any request, for any reason we consider not to be in the best interest of the Websites and their users. We link to organizations which are business-related only. Before making any link, we will review the overall content of the prospective website. We reserve the right not to link, or remove the link, to a particular site at any time.

General Provisions

Hershey reserves the right to revise these Terms from time to time by posting revised Terms, and your continued use of the Websites thereafter will constitute agreement with such revisions. Hershey products are available in many parts of the world. However, the Websites may describe products that are not available worldwide. If any portion of these Terms is held to be unenforceable, the unenforceable portion shall be construed in accordance with applicable law to the greatest extent possible and the remainder of the provisions shall remain in full force and effect. Any cause of action you may have with respect to the Websites must be commenced within one year after the claim or cause of action arises or such claim or cause of action is barred.


You should assume that everything you see or read on the Websites is copyrighted (unless otherwise noted) and may not be used except as provided in these Terms or in the text on the Websites without the written permission of Hershey. Hershey neither warrants nor represents that your use of materials displayed on the Websites will not infringe rights of third parties not owned by or affiliated with Hershey. Images, photographs, or illustrations displayed on the Websites are either the property of, or used with permission by, Hershey. The use of these materials by you, or anyone else authorized by you, is prohibited unless specifically permitted by these Terms or specific permission provided elsewhere on the Websites. Any unauthorized use of the images may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes.


The trademarks, logos, service marks, brand identities, title, characters, trade names, graphics, designs, copyrights, and other properties appearing within the Websites (collectively, the "Trademarks") displayed on the Websites are protected intellectual properties that are registered and unregistered trademarks of The Hershey Company, its affiliates, and others. Nothing contained on the Websites should be construed as granting, by implication, or otherwise, any license or right to use any Trademarks displayed on the Websites without the written permission of Hershey or such third party that may own one or more of the Trademarks displayed on the Websites. Your misuse of the Trademarks displayed on the Websites, or any other content on the Websites, except as provided herein, is strictly prohibited.
